Summary

This one-hour presentation will cover a variety of topics relating to mortuary law, with a focus on both state and federal regulations of the funeral industry. By exploring current trends in mortuary litigation, including an analysis of some particular cases that have resulted in astronomically high plaintiff’s verdicts in recent years, attendees will gain a heightened awareness of their own potential exposure to liability as death care professionals, while being guided through the concepts of risk management and developing best practices, with an emphasis on being proactive rather than reactive. There will also be a discussion about the importance of communicating effectively with families, as well as mitigation tactics to decrease the likelihood of a lawsuit being filed if and when a mistake does occur.

Emily’s niche funeral law practice includes mortuary defense litigation, state regulatory authority administrative adjudication matters, FTC Funeral Rule compliance, internal inspections and/or investigations, risk management, best practices and liability avoidance consulting for funeral homes, cemeteries, crematories, funeral directors and embalmers. She also serves as General Counsel for the Washington State Funeral Directors Association.
