Summary:

In the first hour of this two-hour presentation, OFDA General Counsel Scott Gilligan will focus on preneed legal issues. Included in the presentation will be a review of Ohio’s extensive preneed consumer protections such as direct deposit, the preneed recovery fund, confirmation of deposit, portability, and preneed contract disclosures. Scott will also discuss the interplay of Medicaid regulations and preneed that offer various preplanning and prefunding options for Ohio families. Finally, he will review for the attendees the new preneed law changes that are being proposed in legislation sponsored by the State Board and OFDA. There are several important modifications to the preneed law contained in HB 524, many of which will impact preneed funding and sales practices. Attendees will be updated on the status of the Bill and how the changes in the legislation will impact how preneed funds are paid, collected, and processed.

In the second half of the presentation, Scott Gilligan will provide an update on the federal and state legal issues facing the funeral profession. This presentation will include a discussion of the ongoing review of the Funeral Rule by the FTC, including several important ways to improve compliance and avoid FTC penalties. Scott will also discuss the changes to the Rule that various consumer groups are seeking as well as those revisions and refinements that the funeral profession believes are long overdue. The final portion of the presentation will discuss other changes that will take place to funeral licensing laws, fetal death certificates, crematory regulation, the right of disposition, and funeral processions if HB 524 is enacted.

Scott Gilligan

T. Scott Gilligan is an attorney with Gilligan Law Offices in Cincinnati, Ohio. Mr. Gilligan serves as the General Counsel to the National Funeral Directors Association, the largest organization of funeral directors in the country (“NFDA”). Mr. Gilligan has worked on NFDA matters since 1982 and became General Counsel for the Association in 1993. In addition to his representation of NFDA, Mr. Gilligan serves as the General Counsel for the Ohio Funeral Directors Association.

Mr. Gilligan graduated in 1976 from the Georgetown University School of Foreign Service in Washington, D.C. He obtained his law degree from Georgetown University Law School in 1979.

Mr. Gilligan, whose family has been in funeral service for over one hundred and thirty years in Cincinnati, Ohio, has authored the 2012 edition of Mortuary Law, a textbook widely used in mortuary colleges. He has also provided numerous seminars to funeral associations throughout the country on FTC Funeral Rule compliance, legal liabilities faced by funeral homes, and updates on regulatory and legislative issues impacting the funeral profession.

In addition to his work for funeral associations, Mr. Gilligan and his law firm have been involved in over 250 funeral home and cemetery acquisitions and divestitures across the country. He has represented both buyers and sellers in transactions ranging from small independent funeral homes to large funeral and cemetery chains.

  2. The options that are available to Medicaid applicants to spend down resources by prefunding their funeral services and pre-purchasing burial space items for immediate family members.
  3. How HB 524, if enacted, will change important preneed requirements governing the payment, collection and processing of preneed funding.

Laws/Rules Presentation:

  1. Why the FTC Funeral Rule failed to achieve its goals of increasing funeral consumer price shopping and lower funeral prices.
  2. What changes the funeral profession is seeking in the Funeral Rule to increase compliance and better serve the funeral consumer.
  3. How changes in HB 524 will improve the right of disposition law, crematory practices, fetal death certificates, and funeral procession options.
