In the first hour of this two-hour presentation, OFDA General Counsel Scott Gilligan will focus on preneed legal issues. Included in the presentation will be a review of Ohio’s extensive preneed consumer protections such as direct deposit, the preneed recovery fund, confirmation of deposit, portability, and preneed contract disclosures. Scott will also discuss the interplay of Medicaid regulations and preneed that offer various preplanning and prefunding options for Ohio families. Finally, he will review for the attendees the new preneed law changes that are being proposed in legislation sponsored by the State Board and OFDA. There are several important modifications to the preneed law contained in HB 524, many of which will impact preneed funding and sales practices. Attendees will be updated on the status of the Bill and how the changes in the legislation will impact how preneed funds are paid, collected, and processed.
In the second half of the presentation, Scott Gilligan will provide an update on the federal and state legal issues facing the funeral profession. This presentation will include a discussion of the ongoing review of the Funeral Rule by the FTC, including several important ways to improve compliance and avoid FTC penalties. Scott will also discuss the changes to the Rule that various consumer groups are seeking as well as those revisions and refinements that the funeral profession believes are long overdue. The final portion of the presentation will discuss other changes that will take place to funeral licensing laws, fetal death certificates, crematory regulation, the right of disposition, and funeral processions if HB 524 is enacted.

Mr. Gilligan serves as the General Counsel to the National Funeral Directors Association, the largest organization of funeral directors in the country (“NFDA”). Mr. Gilligan has worked on NFDA matters since 1982 and became General Counsel for the Association in 1993.
