Understanding Legal Issues in the Arrangement Conference

Summary

In this presentation, OFDA General Counsel Scott Gilligan will discuss the many legal issues that arise during the arrangement conference. Included in the presentation will be Ohio’s right of disposition law, contract law, creditor/debtor law, and information on credit card surcharges. From documenting who has the authority to make arrangements, what will be done in the preparation of the decedent’s remains, and who will pay for the funeral, there are critical decisions that must be made and documented. The presentation will include how to use a dozen different forms to help funeral homes step safely through this legal minefield.

This program was originally presented during the OFDA Annual Convention on May 23, 2019. If you attended the program and received CE credit at convention you are NOT permitted to receive additional credit for the webinar during the 2019-2020 compliance period.


Presenters

T. Scott Gilligan
T. Scott Gilligan is an attorney with Gilligan Law Offices in Cincinnati, Ohio. Mr. Gilligan serves as the General Counsel to the National Funeral Directors Association, the largest organization of funeral directors in the country (“NFDA”). Mr. Gilligan has worked on NFDA matters since 1982 and became General Counsel for the Association in 1993. In addition to his representation of NFDA, Mr. Gilligan serves as the General Counsel for the Ohio Funeral Directors Association.

Mr. Gilligan graduated in 1976 from the Georgetown University School of Foreign Service in Washington, D.C. He obtained his law degree from Georgetown University Law School in 1979.

Mr. Gilligan, whose family has been in funeral service for over one hundred and thirty years in Cincinnati, Ohio, has authored the 2012 edition of Mortuary Law, a textbook widely used in mortuary colleges. He has also provided numerous seminars to funeral associations throughout the country on FTC Funeral Rule compliance, legal liabilities faced by funeral homes, and updates on regulatory and legislative issues impacting the funeral profession.

In addition to his work for funeral associations, Mr. Gilligan and his law firm have been involved in over 250 funeral home and cemetery acquisitions and divestitures across the country. He has represented both buyers and sellers in transactions ranging from small independent funeral homes to large funeral and cemetery chains.   Collapse
